Charter
Agreement
PAYMENT
An
initial NON-REFUNDABLE deposit of THREE HUNDRED DOLLARS is
due with a signed charter agreement.
No
dates will be guaranteed longer than 10 days without a
deposit.
The balance of the total payment is due four
weeks prior to the charter date. If the balance is
not timely paid BWE may at its option and without notice
cancel the charter and retain the deposit as liquidated
damages.
REFUNDS
All
deposits will be retained for cancellations.
A refund of charter payments (not including
deposits) will be made if the CHARTERER cancels its
reservation four weeks or more prior to the cruise date.
We
sail rain or shine.
In
the case of severe weather conditions or upon direction of
the U.S. Coast Guard, the vessel may remain dockside
for the length of the event and no compensation will be due
the charterer. In
the event of breakdown or lay-up for repairs, a refund of
the charter payment for sailing time not used will be made
by BWE and the CHARTERER hereby releases BWE from any other
incidental, consequential, or damages of any kind resulting
therefrom.
ROUTE
The
navigational route of the vessel shall be at the sole
discretion of BWE.
BOARDING
& DISEMBARKING
Guests
may board no earlier than 20 minutes prior to the scheduled
departure time.
Caterers, musicians, and decorators may (if the
vessel is available) board 40
minutes prior to the scheduled departure time.
Disembarking must be no later than 15
minutes following the disembarking time or arrival at
the dock whichever is later. If additional time aboard is
required or used, it will be billed at the prevailing hourly
rate in ¼ hour increments.
ENTERTAINMENT
& DECORATIONS
If
additional music is desired, the CHARTERER may hire at its
own expense musicians or DJ who must be included in the
total capacity count of the vessel. DJ's and musicians will
perform under conditions set forth by BWE. Noise ordinances
will be enforced. The Captain will determine acceptable
levels of volume. Any form of special dancing or
entertainment is not permitted without written consent from
BWE. Any form
of decoration of the vessel must have prior consent from BWE.
Equipment and decorations must be removed from the vessel by
the “disembarking time”. The CHARTERER is responsible
for informing the musicians or decorators to contact BWE to
discuss conditions and boarding arrangements. BWE will not
be responsible for damage to any equipment brought aboard by
the CHARTERER or their entertainers.
CATERING
NO
FOOD OF ANY KIND MAY BROUGHT ON BOARD WITHOUT ADVANCE WRITTEN
APPROVAL FROM BWE.
BWE
reserves all catering and refreshment privileges
and all concessions, whether sold or given away.
Menu
selections with an accurate number of guests and catering
balance are due at least FOUR WEEKS prior to sailing. No
food will be ordered without the balance paid.
With the exception of breakdown or lay-up for
repairs, there can
be no refunds of payment or deposit for food service. Guests
may be added (but not deleted) up to 48 hours prior to your
cruise date.
Unconsumed products remain the property of the
caterer. Any
servers employed by the caterer or CHARTERER must be
included in the total capacity count of the vessel.
Outside
catering either hired or "self-catered" may be
brought aboard for an additional $200.00.
All outside caterers are responsible for plates,
dinnerware, napkins, buffet tablecloths and skirts, etc. and
must provide necessary cleanup at the end of the charter.
All equipment and food must be removed from the vessel by
the "disembarking time". BWE reserves the right to
refuse serving any food that may, in BWE's sole discretion,
cause damage to the vessel, create excess cleanup, or may be
unfit for consumption. BWE assumes no responsibility
for illness caused by any food item brought aboard the
vessel by the CHARTERER or its caterer.
REFRESHMENTS
BEVERAGES MAY NOT BE BROUGHT ABOARD THE VESSEL.
The
Huron Lady II is licensed by the State of
Michigan for liquor sales.
No one under 21 years of age may consume alcoholic
beverages. Valid
identification is required.
The bar will close 15 minutes prior to docking
without a formal announcement. All bar bills are to be paid at the end of the cruise.

THE BAR MAY BE CLOSED TO ALL GUESTS OR THE CHARTER
MAY BE TERMINATED IF ANY UNDERAGE GUESTS ATTEMPT TO PURCHASE
OR CONSUME ALCOHOLIC BEVERAGES.
IT IS THE CHARTERER’S RESPONSIBILITY TO INFORM
THEIR GUESTS OF THIS POLICY. (See RESPONSIBILITY below)
RESPONSIBILITY
The
CHARTERER is responsible for preserving order among its
guests.
The CHARTERER agrees to be responsible for any cost
or expense incurred by BWE as a result of any such damage.
One person (the contact person unless otherwise
specified) will be designated by the CHARTERER who will act
as liaison between BWE and the CHARTERER'S guests.
BWE reserves the right to restrain, debark, refuse
boarding of any person, or terminate the voyage at any time
when, in BWE's sole discretion, a guest's conduct
jeopardizes the safety or property of the vessel or any
passenger, is inappropriate, illegal, or may affect the
reputation of BWE, its crew, or vessel. In any situation of
this kind, no refund of charter or catering fees will be
made in whole or in part and BWE shall not assume any
obligation whatsoever.
IMPORTANT
NOTICE: This document is subject to change and may be
superceded by the agreement you receive. Please read
yours carefully before signing.
